1.     This Offer is sponsored and organized by Mobile2win India Pvt. Ltd , a company having its office at Eco Space Building, 3^rd Floor, Office No 306, I.T. Park, Off Old Nagar Das Road, Mogra Village, Andheri (East), Mumbai – 400069 (hereinafter referred to “Vendor”) in association with Idea Cellular Limited, a company having its registered office at Suman Tower, Plot No. 18, Sector – 11, Gandhinagar – 382 011 and Corporate Office at 5th Floor, Windsor, Off CST Road, Kalina, Santacruz (E), Mumbai-400098 (hereinafter referred to “Idea”) and the Offer is open for a limited period from  3/5/2010 00:00 hrs till 31/5/2010 23:59 hrs for the pre-paid as well as post-paid category of cellular subscribers in Mumbai circle of Idea Cellular Limited telecom circles. 

2.      This Offer is valid only for existing category of active Subscribers who fulfill the following criteria:

• The participant must be above 18 years of age.
• He must be a citizen of India.
• He must not have any criminal record nor be of an unsound mind.
• You must not have been either prosecuted or convicted for commission of any criminal offence.
• The customer should have submitted all valid documents as per DoT guidelines
• Must be a customer for Idea as on 2^nd May, 2010

3.     This Offer is being made purely on a “best effort” basis and participation of eligible subscribers is voluntary.

 

4.     TERMS & CONDITIONS:

The IDEA Subscription contest is a limited period offer.

1. The contest will be open from 3^rd May (00:00 HRS) to 31^st May 2010. (23:59 HRS).
2. The contest is open for residents of India only.

To Participate:

• She/he should be an Active Idea Mumbai subscriber
• She/he has to subscribe and be successfully charged for atleast one day for any one or more of the services mentioned above.
• There are no entry charges or entry cost for participation.

·         Participation in this Competition implies acceptance to all the terms and conditions of the Competition mentioned herein.

 

5.     Promotions:

Promotions for this activity will be done via USSD and SMS.

6.     Subscriber shall directly contact Vendor at 022-42153497 regarding any queries / complaints. Alternatively the subscriber can send an email to feedback@mobile2win.com. All disputes must be addressed by the Subscriber in writing to Vendor directly and IDEA shall not entertain any communication in this regard.

7.     IDEA shall reserve the right to offer an invitation for participation.

8.     The Offer is open for participation only for the existing active Subscribers of IDEA Cellular Limited in Mumbai. The Offer is not applicable to Roaming Subscriber/s* (Pre-paid Subscriber/s who are visiting Mumbai Telecom Circle from other Telecom Circles and who do not belong to Mumbai Telecom Circle).

9.     The subscriber/Participant shall mean the rightful owner/user of the mobile connection and a person/individual in whose name the mobile phone number is registered as per the records maintained by IDEA Cellular Ltd (and which shall be conclusive), or in case of an employee who is the user of the phone registered in the name of an employing company, provided that the employing company issues a letter that the employee has been allotted the specific mobile phone number. Further, the winner will be the rightful owner/user of the winning mobile phone number (which is registered as per the records maintained by IDEA Cellular Ltd (and which shall be conclusive), and not the player, if such player is not the rightful owner/user of such mobile number. If the winner is not able to provide sufficient evidence to show that he/she is the rightful owner/user of the mobile, IDEA reserves the right to award the pass to the next eligible winner. 

10.  The Subscriber hereby further understands and agrees that Vendor shall be responsible for inter-alia the selection of the winners and delivery of the prizes. Vendor shall be liable for all/any representations/warranties/communications made to the Subscriber regarding the aforesaid.

11.  The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the Subscriber to be exchanged with Vendor.

12.  Idea is neither responsible nor guarantees the quality of the goods/ services being offered as prizes nor is liable for any defect or deficiency of goods or services so obtained/availed, by the subscribers under this Offer. Vendor is also not liable for any defect/ deficiency in the prize(s) so offered or availed, by the subscribers under this Offer.

13.  The prize(s) under the Offer is neither assignable nor transferable under any circumstances.

14.  All the prizes shall be subject to such other terms and conditions as may be applicable to specific prizes and shall have to be duly complied with by the winner.

15.  The prize(s) to the winner shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the prize(s) and on production all such documents/papers as required by Vendor before accepting the delivery of the prize. Any failure on the part of the winner to comply with directions issued by Vendor for claim of prize shall entitle Vendor to forfeit the prize(s).

16.  In case the Prize is not available, any gift of equivalent value will be given by Vendor. If the prize is not available or if it is difficult to deliver the prize to any location of the Consumer or for any such reasonable cause at the sole discretion of Vendor, the price can be given in cash or cash equivalent. In case of cash prize the distribution of cash prize can be through account transfer, Cheque or Money Order or such other mode as may be prescribed by Vendor.

17.  All incidental costs/taxes/levies related to the prize(s) shall be exclusively borne by the subscriber including, but not limited to, TDS, Gift tax (if any), Road Tax, Insurance and any other taxes applicable by the government Central, State or Municipal.

18.  Vendor may, to its best ability, inform the winners by calling them on their Mobile or Telephone Numbers. All prizes must be claimed by the winners, along with the documents specified herein below at the venue of the event. The documents required to be submitted along with the claim by the winner include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):

• Identity Proof
• Address Proof
• PAN Card and
• Letter of Compliance with rules and regulations etc 

19.  The employees of Idea & Vendors and their group companies, affiliate or associate companies shall not be eligible to participate in this Offer.

20.  The Subscriber hereby agrees and undertakes not to hold Idea/ Vendor and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that the Subscriber may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of the present Offer.

21.  Idea/Vendor shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to a Subscriber and/or any third party, directly or indirectly, by use or non-use of the prize.

22.  The prize(s) must be claimed within 30 days of receiving the intimation from Vendor failing which Vendor reserves the right to forfeit the same.

23.  The Prize or its equivalent shall be handed over by Vendor on receipt of all the documents, from the winner, required to process the distribution of the Prize.

24.  This Offer cannot be used in conjunction with any alternate offer or promotion.

25.  This Offer is subject to force majeure circumstances i.e. Acts of God or any circumstance beyond the reasonable control of Idea/ Vendor.

26.  The terms and conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form.

27.  The Offer is valid subject to compliance with all formalities as required by Idea/ Vendor. Any failure on the part of the subscriber to comply with the specified formalities shall disqualify the Subscriber.

28.  This Offer is subject to guidelines/ directions issued by Telecom Regulatory Authority of India or any other statutory authority from time to time.

29.  The decision of Vendor in respect of all transactions under this offer shall be final and binding.

30.  Idea and Vendor reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer or any part thereof including the eligibility criteria at its sole discretion at anytime during its validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber.

31.  The present offer is organized and administered by Vendor.

32.  Participant/Subscriber/s assume liability for, and shall defend, indemnify and keep harmless the officers, directors, employees, successors and assigns of Idea & vendor from and against any and all liabilities, obligations, losses, damages, penalties, claims, demands, actions, suits, costs and expenses (including, without limitation, reasonable legal fees and expenses), arising from claims of third parties/subscriber/s or otherwise or from any government or statutory bodies, of whatsoever kind or nature, imposed on, incurred by or asserted against the parties, resulting from, arising out of, or incurred with respect to (i) the breach of any covenant or warranty or representation, or a material breach of this terms and conditions, or (ii) the performance of the services, (iii) infringement of the  (intellectual property rights), title, and interest in all Copyrights, Artistic Works, Logos, Trade Dress, Service Marks, Trade Marks, Trade Names, etc. 

33.  Unless the context clearly requires otherwise, (a) "shall," "will," and "agrees" are mandatory and "may" is permissive; (b) "or" is not exclusive; and (c) "includes" and "including" are not limiting. The singular includes the plural and vice versa and words importing a gender includes other genders.

34.  The Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in Mumbai.
